Albuquerque Trust Litigation Attorneys

New Mexico firm represents beneficiaries and trustees in disputes

Disagreements over the management and distribution of trust assets can be highly contentious and costly. If you believe a trust is not being administered properly or if you have been wrongly accused of trust mismanagement, effective legal counsel is required. At Hurley, Toevs, Styles, Hamblin & Panter, P.A. in Albuquerque, we are seasoned attorneys who represent clients in trust litigation cases throughout New Mexico. Our lawyers have a detailed understanding of the applicable laws and provide determined advocacy in support of a result that affirms the wishes of the trust settlor. Whether your conflict relates to a trustee’s performance or the construction of trust language, you can rely on us for high-level advice and advocacy.

Challenges to the validity and administration of trusts

If you believe that a trust is the product of undue influence or was created by someone who lacked the capacity to consent to a legal instrument, our firm can advise as to whether contesting the trust’s validity would be wise. We frequently represent fiduciaries named to manage trusts, conservatorships, and estates in managing difficult beneficiary situations and defending allegations of breach of fiduciary responsibility, which can include challenges to distribution decisions, investment returns, and general administrative matters.  As to these claims, we also represent beneficiaries who believe that the entity in which they have an interest has been mismanaged.

Trust modifications to reflect changed circumstances

As a matter of course, our firm assists settlors who seek to modify a revocable trust they previously created. Modifying an irrevocable trust after a settlor’s death is a more complex process. Generally, a modification of an irrevocable non-charitable trust may be amended by all trust beneficiaries if a material purpose of the trust is not impaired by the modification. If not all beneficiaries consent to the revision, it might still be allowed if the nonconsenting beneficiary’s interests are adequately protected.
