New Mexico attorneys provide trustworthy legal guidance

Tax issues can impose a heavy burden on families and companies. At the law firm of Hurley, Toevs, Styles, Hamblin & Panter, P.A., we help clients effectively address federal and state tax matters. Our tax attorneys will work to resolve your problem as promptly and cost-effectively as possible given the particular circumstances. We serve individuals and businesses throughout New Mexico from our Albuquerque office.

Skillful counsel for tax planning, audits, litigation and debt matters

In our tax law practice we assist clients with challenges related to the following issues:

  • IRS audits — Returns you’ve filed in the last three years can be the subject of an IRS audit. This period could even be longer if extensive errors are found. Some factors that can draw the attention of auditors include missing information in returns, mathematical mistakes and the filing of an amended return. Audits may be conducted in person or through correspondence depending on the specific concern and the amount of documentation to be reviewed.
  • Tax debt relief — If you owe more in taxes than you can pay, there may be help available to you. Our tax attorneys can advise on the likelihood of negotiating a reasonable settlement or establishing a payment plan to meet your obligation.
  • State and local tax issues — Inquiries from state and local tax authorities can be as problematic as federal reviews. We can help you understand complex tax codes so you don’t run into problems, and will advocate on your behalf should questions arise about your compliance with the applicable regulations.
  • Business tax planning — Smart tax planning helps companies avoid unnecessary payments and potential investigations. As experienced business lawyers, we know how the right strategy can help you take advantage of deductions, exemptions and other beneficial tax provisions.
  • Tax litigation — Sometimes tax disputes must be resolved through litigation in the U.S. Tax Court or another forum. We represent clients in civil disputes with federal and state tax authorities when you believe the agency is targeting you without proper justification.

Whatever your issue, a knowledgeable tax law attorney from our firm will pursue the best possible outcome for you.

Settling and litigating tax debts

Though we are strong Tax Court litigators, there are many ways to reach a satisfactory resolution to a tax law matter without going to trial, such as:

  • Offer in compromise — With an offer in compromise, you settle your tax bill for less than you owe. You make an offer to the IRS about how much you can pay, and pay that amount if it is accepted. Typically, offers are considered if the agency believes that is all they can get from you within a reasonable time period, or if paying the full amount would create a financial hardship. We can discuss the eligibility requirements with you and the amount of an offer likely to be accepted.
  • IRS payment plan — If you are unable to provide the taxes you owe all at once, you might qualify for a payment plan. Depending on the balance, you could fulfill your obligation through a long-term or short-term payment plan. IRS payment plans are available to both individuals and businesses.
  • New Mexico tax payment plan — When someone cannot pay their state tax balance immediately, New Mexico offers short-term payment plans of 12 months and long-term plans of up to 72 months. For the long-term payment plan, a lien against your property is required to be put in place.

Our tax lawyers can help you determine what solution best fits your circumstances. From there, we’ll assist you in preparing the application and supporting documentation.
